`Kenzo`, an international perfume company, has sued two businessmen for importing counterfeit Kenzo perfumes into Sri Lanka. The Customs Department detected and detained the cargo. Kenzo, is a famous brand with having many outlets worldwide.
Two businessmen, Abdul Hassen Abdul Hakeem and Fathima Askia Mohamed Asker, who were carrying on business under the name of Blue Sky Enterprises at Keyzer Street, Colombo 11, were alleged to have imported the illegal cargo. The petitioner company pleaded for a Court order restraining the respondents from importing and selling the counterfeit perfume in Sri Lanka.
The plaintiff company markets KENZO perfumes Sri Lanka exclusively through an agent in Majestic City. They have registered the trademark `KENZO` in Sri Lanka. After being informed that a consignment of counterfeit KENZO perfume products were being imported to Sri Lanka, in the Vessel Newport Bridgean, they had informed the Customs.
