Allaipiddy case stalls in Kayts Courts

The progress in Allaipiddy murder case, where five members of the same family were allegedly massacred by soldiers of the Sri Lanka Navy (SLN), has stalled in Kayts District Courts due to lack of co-operation from the Attorney General`s (AG`s) Department, lawyers associated with the case said. Hearings that were to take place on the 30th of August 2006, were finally held on the 14th March Wednesday, after several postponements due to the break out of violence in August last year.

The hearings were again postponed to latter part of May due to lack of instructions from the AG, legal sources said.

Kayts District Court Judge, Jeyaraman Trotsky, during 19th July 2006 hearing warned the high ranking police officer Mahes Perera and his investigation team that charges of contempt to court may have to be brought against them for failing to appear before the Court. Mr Mahes Perera and his team were tasked to inquire into the Allaipiddy killings and to submit the inquiry report.

Following the July hearing, Mr Trotsky requested the Attorney General department to advice him on the how to proceed with the case in the light of the non-cooperation of the Sri Lanka Police and legal need to have an identity parade SLN sailors for witnesses to identify the perpetrators of the crime, legal sources said.

Legal sources said that the AG department has failed to provide any support or take actions to facilitate forward movement of the investigations.

Informed sources said that the SLN officers have informed the AG`s office that due to security reasons they will not be able to assemble 50 to 60 SLN soldiers in one place for the identity parade. Attorney General is considering holding the identity parade in Amparai or Trincomalee, sources said.

Legal sources said that the attempt to move the identity parade to a Sinhala court is tantamount to derailing the case as witnesses from Jaffna are unlikely to be willing to travel.

Sri Lanka has come under increasing criticism for the lack of transparency in the judicial process, and the reluctance at the high levels of the political leadership to prosecute members of the Security forces responsible for several massacres and extra-judicial killings.

Is anyone suprised about the outcome of this trial?
Let me make things even easier for everyone.
SLN not guilty. Don't ask how ory why. It is that.
Now everyone go on your business like nothing happened.
It were just some worthless Tamils , what difference will that make. We are trying to kill all of them anyhow.
What can the Tamils do about it? Nothing.
We can slowly kill the Tamils off like thisnone of the political parties will do anything, we are paying them to keep quiet. Only LTTE is the only group who will do anything but we have managed to make them a Terrorist organization and there is nowhere they can go to make any complain. We have full license to kill the Tamils as we like.
Just make sure the LTTE is blamed for everything and we will be safe.

I do not know who cursed this Paradise Island. Was it Kuweni's curse.
But it was a very strong curse, Murders and killings are abundant in all areas of the Island.

Justice is the joke of the millenium in Lanka.

Absence of swift justice is nothing new and should not be made into a communal issue.This seems normal in SL.

Well are we expected to accept it blindly? According to DBS Jayraj The family who were killed were known intelligence operatives of the LTTE. Under the prevailing situation in the country where it is not possible to get witnesses to give evidence in court agains organisations such as the LTTE and JVP it may be possible to accept (though not justify) this kind of action. But my question is why kill a 4 year old child? What kind of depraved mind could do such a thing? Also how about the NGO workers in Muttur? Hands tied behind their backs and summarily executed. Reason? It was probably over an argument at an army checkpoint or some small thing like that. They saw their chance when the LTTE attacked Muttur and then murdered them in cold blood.

The scary thing is most normal people subjected to the de humanising conditions of war over time turn into monsters capable of such deeds. E.g. Ordinary Germans under the Nazis, American GIs in Vietnam (Remember My Lai?), British in Malaya and Kenya, IPKF in Sri Lanka and so also the LTTE and SL Forces. We should all therefore make some difficult compromises in order to end this conflict as soon as possible or before long we'll all be transformed into homicidal beasts like the perpertrators of these massacres. Then its only a matter of time before we experience a tragedy on the scale of the Interhamwe in Rwanda. The way things are going in Sri Lanka its not such a remote possibility..

At a time when govt's human right record is under scrutiny it is a good opportunity for the govt. to make sure that this process will correctly punish the guilty.

It is no point GOSL saying that they will appoint a commission when ever a disaster occurs just to buy time and forget about it.

If the security forces are guilty and if they can get away all the time what is the difference between the govt. and the LTTE?

Where the government is not able to raise its work to the international level, it must stop calculating and help others FEEL. When sacrifices are made by minorities towards common pooling, any damage to their work takes the person causing such damage to the lowest levels of ownership and confidence.

The current leadership in Sri Lanka belongs in this category.
