The Attorney General yesterday gave an undertaking to the Court of Appeal that Charles Gnanakone will be released from police custody.
The Deputy Solicitor General, Jayantha Jayasuriya, told the Court that having considered the representations made by Faiz Mustapha PC, the AG had decided to direct the release of Gnanakone.
In view of the undertaking given by the Attorney General, the Counsel for the petitioner moved to withdraw the Habeas Corpus application, which was filed by an Australian national, resident in Sri Lanka, seeking the release of Gnanakone.
The petitioner, Smet, had said that Ganakone had been arrested and detained without a reason. He had been questioned in connection with the Kadirgamar killing.
Among the respondents are the Director of the Crime Investigation Division, Colombo, the IGP and the Attorney General. Faiz Mustapha PC, appeared with Mrs. Faizar Markar, and Ms. Machado, instructed by Mrs. Gowri Shangari Thavarasa, for the petitioner smet. The Bench comprised Justice S. I. Imam and Justice N. L. R. Silva.
