Colombo High Court Judge Rohini Perera yesterday acquitted all the accused in Richard de Zoysa murder case. The three accused ASP Lal Priyantha Ranchagoda, OIC Anuradhapura B. G. Devasurendra and Sergeant M. W. Sarachchandra were thus released from all the charges.
Journalist Richard de Zoysa was kidnapped and murdered on February 17, 1990. The three accused were charged with the kidnapping and murder of Zoysa.
Delivering the judgment, the Judge stated that the evidence led by the prosecution was contradictory and not credible. The evidence of the only eye witness A. W. Karunaratne was questioned in the Judgement. He had told the CID on the day after the alleged kidnapping, that though he witnessed the incident, he could not identify the suspects as he was in a state of a shock. Later, giving evidence before the Court he had said that he could identify them.
Judge Rohini Pepera acquitted and released the accused saying that the prosecution had failed to prove the case beyond reasonable doubt. Counsel Daya Perera and D. P. Kumarasinghe appeared for the defence.
State Counsel Damith Thotawatte appeared for the prosecution.
