President has no legal authority to sack CJ - UNP

The impeachment motion brought against Shirani Bandaranayake was not properly passed in Parliament, says the United National Party expressing its stance on the removal of the country s first woman Chief Justice by the President today.

Therefore the President has no legal authority to remove Shirani Bandaranayake from the post or appoint a new Chief Justice, UNP General Secretary Tissa Attanayake said in a statement.

President Mahinda Rajapaksa this morning signed the removal notice of Dr. Shirani Bandaranayake, ratifying parliament s vote to impeach her.

On 1 January 2013, the Supreme Court ruled that the impeachment procedure in Parliament was not constitutionally valid and that the PSC established under the standing order 78(A) was unlawful. The Court of Appeal on January 03 exercising writ jurisdiction then quashed the verdict of the PSC.

Hence it is clear that a legally valid inquiry report against Dr. Shirani Bandaranayake has not been submitted to Parliament still, Attanayake said.

He stated that by violating the constitution the President is destroying the judiciary s capability to act independently, while near the doorstep of the upcoming session of the UN Human Rights Council in March.

Attanayake further claimed that through standing up for his brother: Basil Rajapaksa s Divi Neguma bill, violating the constitution by attempting to protect him and by removing Shirani Bandaranayake from the post of Chief Justice, President Mahinda Rajapaksa is proving from actions that our country does not have a judiciary that can function independently and that it s governed by jungle law .

Minister Mervin Silva has made a special request from President Mahinda Rajapaksa. He has asked to be removed from his ministerial portfolio and the Parliamentary seat to be appointed as an ambassador to a foreign country.

The minister has made this request after the situation that cropped up with the murder of the Member of Kelaniya Pradeshiya Sabha.

The Minister had further said that he was prepared to face any investigation and to hand over the post of organizer of Kelaniya electorate to Minister Basil Rajapaksa.

The President has made no response yet for the request made over the phone state sources in Temple Trees.

President Mahinda Rajapaksa met judges of the Court of Appeal today, a day after he met judges of the Supreme Court and only hours after he had signed the warrant giving effect to Parliament's vote on Friday to impeach Chief Justice Dr. Shirani Bandaranayake.

President Rajapaksa explained to the judges the reasons why he impeached the Chief Justice. The judges made no comment except for one judge who was critical of the judgment by the same Court that held the parliamentary process to impeach the Chief Justice being illegal and therefore null and void.

The Sunday Times reported today exclusively details of the meeting on Saturday between the President and the Supreme Court judges. The Chief Justice had however not been invited for the meeting.

A constitutional crisis has arisen with the President sacking Sri Lanka's Chief Justice and the courts holding the removal process illegal.

Will there be any court hearing against her with bench full of judges who were disciplined or sacked by her ?


if she try such things she will loose her Civic Rights and end up in a Jail.
