The two accused who passed information to LTTE for Mangala s assassination given 11 years jail sentence each

he Colombo High Court judge Sunil Rajapakse today (28) sentenced the two accused who confessed to conspiring and providing information to the LTTE regarding the place of residence of former Minister Mangala Samaraweera M.P. in order to assassinate the Minister, to 11 years in jail each.

The two accused are Godakumburegedera Ranaweera alias Malli and D S G Sampath Thusara.

The charges against the accused were, during the period between 31st July and 06th August 2006, conspiring to assassinate the Minister, searching for and providing information to the LTTE members Raheem, Kapilan and David, as well as knowing that information is being sought to kill Mangala Samaraweera and suppressing that from the Police.
The two accused accepted the charges filed against them. They were each sentenced to 11 years in jail commuted to five years.

The conspirators and abettors to the crime must be punished but, at the same time judges/jury must take into account how the confession was obtained, voluntarily or under duress.

In the case of journalist Tissanayagam the judge sentenced to 20 years hard labour knowing well that he was tortured to make the alleged confessions.

Correct me if I'm wrong, Tissainayagam's lawyers alleged that his confession was extracted under threat of torture. They didn't claim that he was actually tortured. In any case, Mahinda Rajapakse granted him a Presidential pardon.

Yes, there is a minor difference between physically torturing and applying mental torture of threat.

The politicised judge wanted to believe the CID evidence obtained under duress which is not what is expected of him.

Pardon was given under pressure from many influential quarters from all over the world. This clearly demonstrated to the world that the SL establishment is run by institutionalised racism.

What this demonstrates is that pressure can be applied to gain the right result, not that SL establishment is institutionally racist. Your logic is a bit flawed, my friend.

What this demonstrates is that pressure can be applied to gain the right result, not that SL establishment is institutionally racist.

In the Bindunuweewa massacre case and in many others no justice was done because IC is preoccupied with numerous other cases to apply 'pressure'. There are many such cases can be cited including that of Kodeswaran's.
In 1962, S. Kodeswaran, a government employee, sued the government on the grounds that the Official Language Act of 1956 violated Section 29 of the constitution. Judge O.L. de Krester upheld Kodeswaran s plea and ruled that the Official Language Act contravened Section 29. The Government appealed to the Ceylon Supreme Court, and the Supreme Court failed to consider the constitutional issue. Kodeswaran appealed to the Privy Council. In 1969, the Privy Council set aside the Supreme Court s decision and directed the Supreme Court to rule on the constitutional question. (72 New Law Reports, p.337.)


The SC deliberately avoided trying the case.

You know the Citizenship Act of 1949 and Sinhala Only Act of 1956 were racist acts intended to discriminate the Tamil speaking minorities.

De-merger of N-E and P-TOMS were outlawed by PC when presided over by Sinhala judges.

SaleemTariq, you are like a dog who licks his wound to keep it clean so that it will heal, the only problem is that you lick it so hard that the wound never heals! Cmon man, do something different tomorrow. You are in UK, right? Go to your nearest Pakistani shop, buy a box of Chaunsa mangoes (also referred to as honey mangoes) that are now in season, and sit down and eat them all one by one. Slowly. Savour every bite. Wonderful stuff! It wont heal that wound but it will certainly stop you from scratching it for a while.

Saleemtariq, do you think these Tamil terrorist would have talked under normal circumstances.
These Tamil terrorist were interrogated under the Emergency regulations and every thing is fair under these regulations.
