This is disgusting, illegal and unethical: Screw you `Diyawadana Nilame`

The Diyawadena Nilame of Asgiriya and Malwatte did not have the physical strength to snatch two baby elephants to please his masters the Mahanayakas of Asgiriya and Malwatte because the parents though their legs have been chained have resisted with all they can to prevent the abduction of their loved ones. These are babies that have not been weaned and still depended on their mothers` milk. If the legs of the parents had not been chained and he fought the parents on level ground he knew that he would have been crushed to pulp and therefore out of cowardice he sought the help of the minister for Wild Life to commit an illegal act involving inhuman cruelty.

The minister in turn may have thought that he had the power to aid and abet in an illegal act and presumably summoned the help of the police. It must have been when even the police failed that he called the army and finally the entire bunch of cowards together snatched the babies from their mothers.

Ifham Nizam reports in the front page of the Island of 28th July 2009 that it is illegal for any animal under the age of five years to be handed over from Pinnawala to outsiders. Moreover according to Environmentalist Lawyer Jagath Gunawardene no animal can be transferred to any place other than the National Zoological Gardens without a permit from the Wildlife Department.

Also according to him depriving the young of mother`s milk could be termed cruelty under the Animal Ordinance Section 3 and 4. According to experts the babies must be weaned carefully and trained before being removed and that the training the babies get from their mother was very essential for their well being.

The report concludes by saying that an official of the Pinnawala had said that the mother elephants were still crying and they too were slightly injured in their attempts to save their young ones. Elephants do not cry the way humans cry but they have their own ways of expressing grief that the Diyawadena Nilame seems to enjoy which the officials of Pinnawala can recognize.

The snatching must have been so violent that according to the report one baby had broken a tusk and the other has also been injured. After the robbery the Diyawadena Nilame has locked up the babies in his garage and one of them has charged a motor cycle in the garage and broken it.

Many questions arise and among them we like to know whether the police have authority to commit an illegal act on the orders of any minister. Who in the police has given the order to act and is that within the police constitution? Similarly who is the army officer who gave the order to commit the same crime and is that also within the constitution of the army? Why is the Jathika Hela Urumaya (JHU) silent on this? Have they got anything called a backbone other than their stupid arrogance that has put off all their supporters to such an extent that none of them will vote for them if they were to come alone as a party?

On the basis of the above evidence we the public expect the government to vigorously prosecute every individual against whom the above charges can be proved. If the government does not, it will deeply sour the elated feelings of the entire nation that we have as a result of the success of bringing together under one flag all ethnic and religious groups in the firm conviction and belief that there is justice and fairness to all in this Buddhist society.

Just one last question about this Diyawadena Nilame. He I understand is elected by a board administering the two temples and he is paid a salary. Is that salary coming from the private estate income of the temples alone without the contributions of the public and any grant from the government? In that case he is answerable to the temples and the law of the land but if even a part of his salary has a public contribution then he is answerable to the public as well.

The day I heard of the kidnapping of the two baby elephants and the cruel treatment that was inflicted on them I was sure that the Mahanayake Theros would order them to be returned to their mothers but I received a shock when I saw the Daily News reporting on Wednesday the 29th July 2009 that the two Mahanayake Theros have denied that the two tuskers taken from the elephant orphanage was a bio-theft because they were publicly donated to them.

There are two aspects to this. One is legal and the other is moral which has no legal binding.

Let us take the legal aspect first. According to the law that has been established no baby elephant can be separated from its mother until it is at least 5 years old and the process of separation takes place gradually over a period of time determined by the officials of the elephant orphanage after it has been weaned. Moreover according to Environmentalist Lawyer Jagath Gunawardene no animal can be transferred to any place other than the National Zoological Gardens without a permit from the Wildlife Department. Also according to him depriving the young of mother s milk could be termed cruelty under the Animal Ordinance Section 3 and 4. In view of the above the Mahanayake Theros have broken the law or violated the established rules all of which are offences.

Drectly as a result of their violation of the established laws that have been drafted taking into consideration the well being of the animals Ifham Nizam reports in the Island of 29/08/2009 that the officials of the Pinnawala elephant orphanage have said that the mothers of the two baby elephants were pining for their off-spring and facing severe health problems. As they could not suckle their babies their nipples were swollen. Unless the animals were allowed to feed their babies their milk might clot their breasts causing severe complications, the sources at the elephant orphanage have said. Does all this suffering mean anything to the two Mahanayaka Theros? We like to know

In view of the fact that the Mahanayake Theros have said that the two baby elephants were publicly donated to them it means that the Diyawadena was acting as the agent for the removal of the baby elephants and as such there are mitigating circumstances in favour of the Diyawadena Nilame though he is not free of the charges.

Now we come to the moral aspect with particular reference to the teachings of the Buddha. The Mahanayaka Theros say that their action of taking the two baby elephants was not a bio-theft because they were publicly donated to them. That means that according to the Mahanayakas the baby elephants were material things and not living sentient beings. There is no provision anywhere in the teachings of the Buddha where a monk can possess a sentient being as a property that he owns. The understanding of the Mahanayakas with regard to what Dana means is not consistent with the Noble Eight-Fold Path that lays out the entire code of conduct in the plane of Sila. The issue at hand does not involve the plane of Samadhi or the plane of Panna. Without going into all these details the best example of Dana is what the Buddha accepted as Dana. He never accepted as Dana living animals or stuffed dead animals. He accepted the barest that was necessary for him to physically sustain himself and when properties were donated to him he vested them in the Sangha. He never had animals to add glory and pomp to his office as the Buddha. Following the example set by the Buddha baby elephants do not constitute a donation to the Mahanayakas.

With regard to whether it was a bio-theft or not the answer to that is that they as monks should not have accepted as a Dana any living sentient being.

We now come to the most serious aspect of the whole thing. By ordering the two baby elephants to be brought to the temples the two Mahanayake Theros have committed the most serious offence of panatipata in the code of conduct known as the Noble Eight-Fold Path. That is the code for everybody other than Arahats who have no code to follow

The word panatipata is purely a Buddhist concept. It has no equivalent in English. Hence the meaning given to it has to be consistent with the Buddha dhamma. The Noble Eight-Fold Path is the complete code of conduct for a Buddhist. There is nothing higher than that. It is only in one of the three items in the step called Right Action (Samma kammantha) that the word panatipata appears. So if one were to translate panatipata as killing does it mean that the Noble Eight-Fold Path permits torture or any other kind of cruelty simply because they are not separately listed in the Noble Eight-Fold Path? Hence even if panatipata is translated as not to harm or kill it still is not consistent with the Noble Eight-Fold-Path. Hence panatipata means not to impose any action on a sentient being against its will that will cause it to suffer. That includes harming, ill treating, depriving its freedom, causing physical or mental pain or killing.

Hence the Mahanatyake Theros by causing suffering to the two baby elephants are guilty of having committed panatipata. That according to the Noble Eight-Fold Path is the most severe violation of the Code of conduct.

The Mahanayake Theros are thus no better than the stupid ignorant Buddhists who keep a dog tied to a post or put it in a cage for any time other than a brief period. The reader could now see that a translation of panatipata as killing or destroying life or onslaught on life cannot be correct because it is not fully consistent with the dhamma. Please note that pana is life, ati is further, pata is fall and hence to give the meaning to panatipata as lowering the quality of life has some justification even though dictionaries say atipata is to kill. We humans are not the only sentient beings. All animals that can sense fear and feel physical pain are sentient beings

I saw the Daily News reporting on Wednesday the 29th July 2009 that the two Mahanayake Theros have denied that the two tuskers taken from the elephant orphanage was a bio-theft because they were publicly donated to them.

Now do you want to screw the Mahanayake's too?
