An individual must be involved at the policy-making level to be culpable for a crime against peace ... the ordinary foot soldier is not expected to make his or her own personal assessment as to the legality of a conflict. Similarly, such an individual cannot be held criminally responsible for fighting in support of an illegal war, assuming that his or her personal war-time conduct is otherwise proper.'

LTTE was not governed the Geneva convention on armed conflict as they were not recognized Army. Hence each individual was treated as a criminal. That's is why each captured or surrendered LTTEr is thrown to the courts system. |

Damed,
Say if you go to Lanka and join SL Army, say the Army commander ask you to shoot and kill 5 tamil civilians on the road. say you have done it. say you go back to japan, if japanese police arrest you for the activity, you can say that you were acting under a command and i am a foot soldier, in the end you can get away with murder. cant charge you as you were really acting under a command. |
