US Judiciary committee reckons with Siva Pasupathy`s letter, although not addressed to USA

Following is the letter written by Mr. Pasupathy arguing why the IMF loan should not be extended to Sri Lanka:

Dear Treasurer,

IMF Emergency Support Loan-US$ 1.9 billion

We have no doubt that your office would be aware of the application made by the Sri Lankan government to the IMF for the above loan. We understand that the loan is to cover the costs of immediate government functions and to pay for post-conflict resettlement.

Our organization, the AHRV, is a registered human rights organization, which seeks to give a voice to the voiceless when their human rights are violated. We understand that the question of whether the loan would achieve the intended objectives and also, whether the government observes the rule of law and complies with human rights, are relevant factors in the determination of an application to the IMF of a loan of this nature.

The US based Human Rights Watch (HRW) has already expressed its deep concern that the loan, which has been sought, will not achieve the intended objectives of the Sri Lankan government. The HRW states that the plight of the internally displaced persons has been exacerbated by the Sri Lankan government`s decision in September 2008 to order most humanitarian agencies out of the Vanni. The government`s own efforts to bring in food, medical supplies, and other relief with a minimal role for the United Nations have been insufficient. Internally displaced persons who escape LTTE territory to what they hope is safety within government-controlled areas have been placed in `welfare centers` that are effectively detention camps . In a recent report of 9 April 2009, the HRW said that the `Sri Lankan government should stop firing heavy artillery into the `no-fire zone` in the northern Vanni area where some 100,000 civilians are trapped by the separatist Liberation Tigers of Tamil Eelam, causing skyrocketing casualties` and further said that the `so-called no-fire zone is now one of the most dangerous places in the world`.

The US Secretary of State, Ms Hillary Clinton, told Sri Lanka`s President, by telephone that Washington was `deeply concerned about deteriorating conditions and increasing loss of life in government designated safe areas.`

The UN High Commissioner of Human Rights, Ms Pillay, warned, `Certain actions undertaken by the Sri Lankan military and by the LTTE (Tigers) may constitute violations of international human rights and humanitarian law`.

The 17th Amendment to the Constitution, which was passed in 2001, was to depoliticize senior appointments to the judiciary and the public service and to curtail the arbitrary power of the executive to appoint persons, who readily comply with even illegal executive directions. However, the failure of the government to comply with this law, has led to proceedings in the Supreme Court which has still not reached finality, mainly due to repeated applications for postponements by the government. The Centre for Policy Alternatives has stated that the `intentional subversion of the 17th Amendment to the Constitution poses a threat to the Rule of Law in Sri Lanka`.

The Bandaranaike-Chelvanayakam Pact of 1957 and the Dudley Senanayake-Chelvanayakam Pact of 1965, constituted a solemn agreement for devolution of powers, between the Prime Minister at the time and the parliamentary leader of the party of the Tamils. Both pacts were later unilaterally abrogated by the government and never implemented. This was followed by a series of riots against the Tamils, non-violent civil disobedience and the demand for self-determination by the Tamils and ultimately to Tamil militancy. Even the present government established an All-Party Representative Committee, with a view to recommending a structure for devolution of powers. A majority report recommending such a structure was submitted to the government about two years ago. The only outcome was the explanation sought by the government from some of its nominees on the Committee as to why they signed the majority report. We have no doubt that this report too, like the two earlier pacts, has been consigned to the dustbin of history.

The New York-based Genocide Prevention Project has placed Sri Lanka among the eight `Red alert` countries, which included Afghanistan, Iraq, Sudan, Congo and Somalia, as currently experiencing genocidal conflict. In the light of the circumstances set out above, we would kindly request you, as a member of the Board of Governors of the IMF, not to approve the grant of the loan and to persuade other members to do likewise. I am also attaching printouts, from which I have reproduced or referred to, some of their contents in the body of this letter.

Sri Lanka needs to develop a more cogent overseas public diplomacy campaign and strategic communication to negate the arguments the global network of the LTTE is engaged in to avoid a situation that it faced with the declaration Secretary of State Hillary Clinton made discouraging the IMF extending the $1.9 billion.

Asian Trash still taking about LTTE. LOL
Justice for Tamils is a dream in Hindian sub continent region. Still worth educating Buddhist Talebans and color TV democracy neighbors.

The first part of the payment will be made to lanka oneday..the second part payment will have lots of demands..

Justice Kanagasabapathy Sripavan had his education at Jaffna Hindu College from 1962 to 1972. After completing his higher studies His Lordship entered the Sri Lanka Law Collge in 1974 and completed his studies there in 1976.Jaffna Hindu Collge has produced several prominent personalities in the legal fraternity and the foremost among them was the former Chief Justice Desamanya Suppiah Sarvananda.

It was when His Lordship Sarvananda was the Chief Justice of Sri Lanka,another Old boy of Jaffna Hindu Collge,Sivapasupathy functioned as the Attorney General. It was a very rare privilege for Jaffna Hindu Collge to have two of its old students adorn Hulftsdorp as Chief Justice and Attorney General . So Justice Sripavan is a descendent of a rich heritatge of Jaffna Hindu Collge which has produced a Chief Justice and an Attorney General simultaneously in the early eighties.

In 1976 Justice Sripavan, obtained a first class at the Intermediate examination for the admission of Attorneys-at -Law . He was enroled as an Attorney-at Law on 23rd August 1977. From 1977 to 1978 Justice Sripavan practiced Law at the Unofficial Bar of Sri Lanka. On 13th February,1978 Justice Sripavan was appointed Acting State Counsel and made permanent with effect from 1st January 1979. On 3rd 1989 ,His Lordship was appointed Senior State Counsel .

Justice Sripavan also had the rare privilege of attending the Queen Mary & West Field College ,University of London. He also obtained his Masters of Law from the University of London in 1994.Justice Sripavan functioned as the Head of the Court of Appeal unit and handled a large volume of work both in the Court of Appeal and in the Supreme Court,including Bills and fundamental Rights applications.

The vast experience and academic qualifications he received both locally and abroad had contributed to a greater extent in the appointment as a judge of the Court of Appeal on 29thMay 2002. So His Lordship Sripavan remains an exemplary figure to this generation of students of Jaffna Hindu Collge.

If there was discrimination, how come he became the Attorney General.


You are a typical Sinhala Modayass, just because one Tamil becomes a Prime Minister or IGP or Chief Justice or Attorney General, do you think that the Tamil grievances/problems are solved or the discrimination against Tamils is finished?

No wonder you people are historically known as Modayass.

Former Chief Justice Sharvananda is dead

Former Chief Justice, DESHAMANYA, Suppiah Sharvananda died in Australia last Wednesday.
The son of headman in Kayts, Chief Justice Sharvananda, received his education at St. Anthony s English School at Kayts, Jaffna Hindu College and Jaffna College. He later obtained a Bachelor of Arts and Bechelor of Laws degrees from the University of London.
He was called to the Bar in 1946 and worked in the chambers of illustrious lawyers of H. V Perera, Q.C, Dr. H. W Thambiah, Q.C, N. Nadarajah K.C and one time parliamentarian, V. A Kandiah.
He enjoyed a lucrative civil practice until he joined the judiciary in 1974. HE WAS APPOINTED TO THE SUPREME COURT IN 1978 AND BECAME CHIEF JUSTICE IN 1984, SUCCEEDING CHIEF JUSTICE NEVILLE SAMAROKOON, Q.C, DURING THE REGIME OF FORMER PRESIDENT J.R JAYEWARDENE. KNOWN FOR HIS ERUDITION, HIS TENURE AS CHIEF JUSTICE WAS MARKED BY SEVERAL LANDMARK JUDGMENTS.
HE WAS THE FIRST CHIEF JUSTICE OF THE TAMIL COMMUNITY IN SRI LANKA.
AFTER HIS RETIREMENT IN 1988, HE WAS APPOINTED AS THE GOVERNOR OF THE WESTERN PROVINCE. LATER, PRESIDENT CHANDRIKA KUMARATUNGA APPOINTED HIM CHAIRMAN OF THE PRESIDENTIAL TRUSTH COMMISSION.

He leaves behind his wife, Pushpawathy and two children Nandakumar and Chandramalar.
Chief Justice Sharvananda s last rites were held in Sydney yesterday.

Not every typical Sinhala Modaya also can become a Prime Minister or IGP or Chief Justice or Attorney General, so maybe Sinhala Modayas also must be having the same grievances/problems. It's just that we being modayas dont realise/think of it as a problem probably..

Oh well! the benifits of being modayas I suppose.. :)

The recent judgement against the sale of SL Insurance corporation stands evident to ascertain when, where and in what kind of institutions that discrimination will not hold water.

The law of the land could be taken to task.

What you are referring to is very much different. It is applicable in the case where there is a CHOICE. For example there are so many engineers, SLAS officers etc.You have many communities making a bulk supply of these personnel.

There were only 09 DIG's when Rudra Rajasingham became IGP in 1977. Siva Pasupathy was the senior most state counsel and Justice Sharvananda was in line to take up the position after Neville Samarakoon.

This cannot be done like in the Army, Navy or Air Force where the basic requisites are amended or totally revised to accommodate their kith and kin or the senior most Commander is given the boot to appoint a political favorite as the chief of the military unit.

About 20 years ago, the Army promoted a 2nd Lieutenant to the position of Captain, through political influence. In order to elevate his status another 20 of his fellows were also promoted of the same commission.
