SC finds treasury secretary guilty on CPC deal-orders compensation and nullifies agreement
(Lanka-e-News, 2008 July 21, 7.20PM)When the FR petition filed by Presidential Advisor and senior Attorney at Law Vasudeva Nanayakkara against a shady deal involving sale of shares of Lanka Marine Services controlled by the Ceylon Petrolium Corporation to John Keels Holdings with approval of former PERC chairman Dr.P.B.Jauasundara came up for hearing today before the three member Supreme Court bench chaired by Chief Justice Sarath N de Silva, the SC bench, delivering its judgment, ordered the nullification of the agreement relating to the deal, payment of a compensation of Rs.500,000 to the state by P.B.Jayasundara. The SC bench also ordered John Keels Holdings, one of the respondents, to return to the Ports Authority, within one month, an 08 acre Bluemendhal landed-property which was transferred to the former under the deal. The SC bench also ordered the respondents to pay a cost of Rs.250,000 to petitioner Vasudeva Nanayakkara.
Petitioner Vasudeva Nanayakkara told the SC bench that the state had incurred a loss of Rs.1200/- million due to the corrupt deal that was signed in gross violation of stipulated tender procedures. The deal was shady and corrupt, lacking transparency relating to sale of state properties, he told the bench.
The deal was signed in 2002 when the UNP was in power and two UNP senior stalwarts who were cabinet ministers then. While the two former UNPers are holding portfolios in the present UPFA government, one of the respondents P.B.Jayasundara is holding a high position as Treasury Secretary presently.
Committee on Public Enterprises (COPE) member, President's Counsel Wijedasa Rajapakse had submitted a report on this corrupt shady deal during its investigations in the past and suggested action against those involved individuals.
The petitioner, Vasudeva Nanayakkara, told the 'Lanka-e-news' that he would forward copies of the SC order to the President, the IGP and the Commission for Investigating Allegations of Bribery and Corruption.
