The Supreme Court yesterday issued an interim order suspending the letter requiring former Security Forces (East) Commander Parakrama Pannipitiya to vacate the staff quarters at Summit Flats.

The Bench comprising Chief Justice Sarath N. Silva, Justices N. G. Amaratunga and Jagath Balapatabendi also issued another interim order allowing him to retain vehicles and escorts he was entitled to as Commander of the Security Forces (East). The interim orders will be operative until the final determination of his fundamental rights petition.

According to the court order, he will get two drivers, six staff cadre, one car, one double cab, one Montero jeep and two motorcycles for tactical escort. The matter is listed for hearing on June 27.

Court granted leave to proceed with his rights petition for the alleged infringement of his fundamental right to equality and equal protection of the law.

Supporting the application counsel Manohara de Silva who appeared for Maj. Gen. Pannipitiya said his client was overall commander in the Thoppigala operation and if proper security was not provided he would have to die on the road.

At this stage the bench observed that with the leadership of the petitioner Thoppigala was captured and that there were enough crowds to celebrate the victory but afterwards this is how those who gave leadership to capture the East is treated.

Making an objection, Senior State Counsel Nerin Pulle who appeared for the Army Commander and other respondents said according to the army regulations Maj. Gen. Pannipitiya could occupy his quarters only for four years but on his request it was extended for four more years. He also said there was an inquiry pending against him and two witnesses had already given evidence. He said the Military Intelligence Director would submit a report to court.

Chief Justice Sarath N. Silva responded saying it was not relevant to this issue. He was not found guilty by the said inquiry and he is still innocent, the Chief Justice said.

Justice Nimal Gamini Amaratunga said once the work was over he was considered useless and the treatment meted out to the petitioner by the army was not acceptable.

Over the media Api Wenuwen Api is aired every half an hour, but people like the petitioner don t even have themselves , Justice Amaratunga said.

In the application Maj. Gen. Pannipitiya challenged his transfer from the post of Commander of Security Forces (East) and the order asking him to vacate his staff quarters at Summit Flats. He also sought permission to retain the vehicles and escorts and other entitlements.

He said under his leadership as the Commander of Security Forces (East) Thoppigala jungles and other major LTTE strong holds in the East were captured by July 2007.

Following an anonymous petition, the Investigations Branch of the Military Police visited him and informed him of an inquiry against him, he said.

Among the allegations leveled against him was a charge that he had used a Captain to manage his properties in Puttalam. Maj.Gen. Pannipitiya denied the allegation saying he or his family members did not own any property in Puttalam.

He said the Army Commander had requested him to submit retirement papers claiming that there had been several allegations against the petitioner.

Later his appointment as Commander of Security Forces (East) was discontinued and was attached to the Army Headquarters.

President s Counsel Manohara de Silva with Ms Pubudini Wickramaratne instructed by Aringa Wijegunawardane appeared for the petitioner. Senior State Counsel Nerin Pulle appeared for the respondents.

What is galling is that such treatment is given to a war Hero because of an ANONYMOUS petition involving a few million rupees while attempts are being made to sweep under the carpets COPE findings, VAT scam and MIG deal where Billions are involved.

DISGUSTING. SIMPLY DISGUSTING.

This is what the court gave him. What did he have before that?

Does every major officer get this amount of security and vehicles.

If they are then at least 30% of the 200,000 are guarding the military officers and politicians which is paid by public funds and the public is walking around without any protection. I politician get bumped they get a cool million and if a citizen dies nothing.

This so called Buddhist state is really fair.

In-fighting in SLA is a sign of turmoil inside the army.

He also sought permission to retain the vehicles and escorts and other entitlements.

The fools had been living like kings by waisting the $billion money that hard working women earned in Arab countries. Now the army losses in Vanni mounting, the infighting had started.

An army coup, similar to the ones in Philippines, may be the next to come!

Buddhist in name only. Everything that is done in this country, in the name of Buddhism and otherwise, is a gross insult to Buddhism and the Buddha. I guess it is also the case in other Buddhist countries like Thailand and Burma, the only difference being that in both Thailand and Burma they don't talk so much about Buddhism and fostering Buddhism as they do in SL
