Judges stay cool
Friday, 2 June 2006 - 4:44 AM SL Time

Justice Gamini Ameratunga is respected as a legal scholar amongst his peers. Many juniors have treaded into his room, when he was in the Attorney-General`s Department, to find solutions to complex legal problems. No one left that room dissatisfied. His knowledge of the law was outstanding, even as a young lawyer. But no one or very would have known that he would some day correct Mr. Upul Jayasuriya over the year in which `Karumkkarayo` was published. He went on to say that he won a prize for the best essay on the same book.
In the sixties, when Karumakkarayo was published, many read it for the wrong reason. They read it for sexual titillation. The incestuous relationship between the daughter-in-law and the father-in-law was the key to this excitement. For the Sinhala reader, this was so uncommon. It was a blockbuster. Now Amerasekera has disowned the book. He has also made some caustic remarks about `Aksharaya` even without seeing it.

Be that as it may, going back to Justice Ameratunga, he has said `We are not a cultural police and we do not want to step into such shoes,` when Mr. Upul Jayasuriya, the counsel for Handagama, objected to the screening of the film before the bench.

One cannot forget the role played by Justice Dr. Shiranee Bandaranike, being a lady and a mother. She was not ruffled by the remarks of the DSG, who followed the famed dictum of Oliver Wendell Holmes `You should study the judges more than your case`, when he said `in adding insult to injury the lady who has an incestuous relationship is a Lady Magistrate in Colombo.` The bench of judges of the Supreme Court was unruffled by these remarks

Justice Bandaranaike asked a very pertinent question from the DSG. If the contention of the Petitioner was true that Child, who had been allegedly abused, stated to the police that he did not see the actress in the nude and that the directors, editors and others used modern technology to shoot the scenes separately, can there be child abuse' What offence has been committed' The DSG remained silent.

It was a temporary victory for the adults in this country. Others, who have become juvenile delinquents in their cultural outlook, will not remain idle. They will work overtime to load society with their infantile theories about sex, incest and culture.the `Anguthhara Nikaya` and `The Bible` are not alone if one is to find incest. History and world literature is full of incidents of incest. If you are a true Christian and therefore believe the Bible then the whole of man kind evolved from Adam and Eve and their two sons Cain and Able. I do not know how this could be perceived by the juveniles if they did not indulge in incest.

Knowing the temperament of the child the censor board prevented them from seeing it. Therefore even if the film is to be screened only adults will be able watch. No infant, child or juvenile should be disturbed by the content of it they will not see it or even if they see it they will watch it and come to conclusions as children. All adults whose mental level is that of children should impose a ban on themselves from watching the film`A0lest they be lured`A0to commit the carnal sin of incest and being hounded by the Child Protection Bureau and other agencies. All adults like Lester, Tissa, Dr. Carlo or the Sucharitha must have sympathy and`A0empathy for them.
